The Board of Education recognizes its responsibility to provide an environment which is secure from known hazards. To protect students and staff members in classrooms, offices, and other work areas, the Superintendent or designee is directed to maintain and enforce safety procedures for the purchase, storage, handling, transportation, and disposal of hazardous materials for all school facilities and operations, including instructional areas and activities.
Hazardous materials are any substance or mixture of substances as defined in 6 CCR 1007-3, of the Colorado Hazardous Waste Regulations, and in 8 CCR 1501-7 of the Rules and Regulations regarding transportation of hazardous materials. Such substances include a variety of materials used in parts of the school operation, from science laboratories and art departments to custodial services and vehicle maintenance, that are or may be hazardous. District personnel are directed to make substitutions for hazardous substances to the extent possible, and minimize the quantities of hazardous substances stored on school property.
The procedures shall establish an ongoing process by which the District identifies and manages potentially hazardous materials in compliance with all applicable local, state, and federal laws pertaining to the safe and proper storage, transportation, and disposal of such substances. The procedures shall include training of individuals who purchase, transport, use, or instruct students using hazardous substances. Curriculum review will ensure instruction for students, consistent with safe use and proper disposal of hazardous materials. Emergency response actions and evacuation plans shall be coordinated with the procedures.
It is not the intent of the Board of Education to expand or modify the District’s potential liability exposure through the adoption of this policy. The District’s voluntary compliance with any statute or regulation to which it is not otherwise subject shall not be construed to create or assume any potential liability under any local, state, or federal law or regulation.
