Policy Code GBCCA-R Policy Name Employee Harassment November 6, 1990

Employees feeling they have been subjected to harassment may use the staff complaint and/or grievance procedure under Board Policy GBM—Staff Complaints and Grievances.
A. The Superintendent shall appoint a complaint officer who shall:
1. Receive complaints of harassment from employees;
2. Confer separately with the complainant and the employee against whom the complaint is made, in an attempt to determine the circumstances leading to the complaint;
3. Confer jointly and informally with both parties, if the complaint officer considers it desirable and both parties consent;
4. Make a determination as to the merits of the complaint and, where appropriate, propose an informal resolution; and
5. Keep the matter confidential, except to the extent that disclosure is required by these procedures.
B. An informal resolution agreeable to both parties closes the matter, except that:
1. The complaint officer shall submit a record of the complaint, including names of the parties involved and its resolution, to the Superintendent. The complaint officer shall maintain a confidential file of such records; and
2. The complainant and the accused may inspect the record and submit a statement to the complaint officer for inclusion in the file.
In the event of employee to employee or employee to supervisor allegations of harassment, the staff complaint portion of Board Policy GBM, Staff Complaints and Grievances, shall be used.
Complainant’s filing of a claim with an outside agency terminates the District process of that grievance or complaint.
