The Board of Education recognizes that students may benefit from having a choice of schools to attend within the public school system that is not limited by school district boundaries.
Nonresident students from other districts within the state who apply pursuant to the regulations approved by the Board of Education may enroll in particular programs or schools within this District on a space-available basis without payment of tuition, except as otherwise provided by the law.
In providing for admission of nonresident students, the District shall not:
Make alterations in the structure of the requested school or to the arrangement or function of rooms within a requested school to accommodate the enrollment request.
Establish and offer any particular program in a school if such program is not currently offered in such school.
Alter or waive any established eligibility criteria for participation in a particular program, including age requirements, course prerequisites, and required levels of performance.
Criteria for Approval of Interdistrict Enrollment
The principal of the school for which application has been made (receiving school principal) will make the decision as to whether an enrollment application is approved or not approved based on criteria established in state law and Board of Education policy. The receiving school principal is responsible for notifying the parents and students of approval or disapproval of the request.
All interdistrict enrollment requests which are submitted in accordance with this policy and accompanying procedures shall be approved and granted unless one of the following circumstances is determined to exist:
The requested school (receiving school) has reached its maximum enrollment limit and lacks the necessary space within its building.
Granting the request would have the immediate effect of causing enrollments in the requested program to exceed class size guidelines under Board of Education Policy IIB or enrollment limits that have been established for that program;
The requested school does not have sufficient teaching staff in the building or in a particular program to meet the student’s needs, and the program cannot be expanded to accommodate added students without addition to or reallocation of school or District resources, including District staff;
The school requested does not offer appropriate programs or is not structured or equipped with the necessary facilities to meet special needs of the student or does not offer a particular program requested;
The student does not meet the established building and District eligibility criteria for participation in a particular program, including age requirements, course prerequisites or required levels of performance; or
The student was expelled from another school district during the preceding 12 months or his/her behavior in another school district during the preceding 12 months was detrimental to the welfare or safety of other students or school personnel.
When nonresident students are applying for admission during the annual District optional enrollment window, first priority shall be given to resident students who apply between October 1 and January 31, as described in Policy JFBA.
Once accepted, nonresident students must indicate an intention to renew their enrollment yearly. If the nonresident student has remained in good standing through adherence to school and District expectations for attendance, behavior (per student code of conduct), and academic effort, enrollment is continued automatically for the next school year, except that resident students who timely apply for enrollment under Policy JFBA shall have priority. If a nonresident student is not in good standing, the student must reapply and will be placed on the same footing as all other nonresident applicants for the next school year. Should a parent/guardian disagree with the enrollment renewal decision, a request for reconsideration can be made using Board of Education Policy KCB. The District reserves the right to rescind and/or amend any or all approved nonresident enrollments in the following circumstances:
In the opinion of the Board of Education, overcrowding of facilities, planned boundary changes, or other conditions develop which require Board of Education attention. In these cases, students approved for nonresident enrollment shall have no greater rights than resident students of the attendance area.
After admission, the District determines that the student has educational needs that were unknown to the District at the time of admission and cannot be met appropriately using existing, in-place, staff, equipment, facilities, space, and other resources without reallocation thereof.
Transportation
Transportation for nonresident students who enroll in the District shall be furnished by the parents/guardians, or emancipated students unless it is determined that transportation is necessary for the District to comply with state and federal law requirements.
Nondiscrimination
The Board of Education, the Superintendent, other administrators, and teachers shall not make any distinction on account of race, sex, ethnic group, religion, or disability of any student who may be in attendance or who seeks admission to any school maintained by the District in the determination or recommendation of action under this policy.
