Policy Name    Review of Decisions at Request of

                                 Community Members

The Board of Education understands that some members of the public may not agree with some decisions made by employees of Littleton Public Schools. The following procedures have been established to provide a system to respond when a decision is questioned.

Level 1 — Initial Reconsideration

Within 30 calendar days of the decision in question, a community member may file a written request for review of the decision with the staff member who made the decision. The request shall include the community member’s reasons why the decision should be reconsidered.

A meeting shall be held between the staff member and the community member within ten business days of the receipt of the request. The purpose of this meeting is to resolve the issue, if possible, at the level where the most knowledge exists. The staff member shall issue a written decision regarding the appeal within ten business days of the conclusion of the meeting. The community member may proceed to Level 2 if the written decision is not issued within the time period or if the decision made continues to be unsatisfactory to the community member.

Level 2 — Supervisory Review

If the conflict is not resolved at Level 1, the community member may apply for a supervisory review to the administrator who supervises the staff member within ten business days of the date of the decision at Level 1, or, in the event of no decision, within ten business days of the due date. The request for review shall be in writing, directed to the supervisor, and shall state succinctly the issues which the community member wishes the supervisor to review. The review shall minimally include a phone conference meeting with the community member and the staff member and review of appropriate documents. It may also include conferences with other individuals outside the presence of the community member and/or staff member. The supervisor will ensure quality and fairness through the incorporation of the established process, then issue a written decision within ten business days of receipt of the request for review. The community member may proceed to Level 3 if the written decision is not issued within the time period or if the decision made continues to be unsatisfactory to the community member.

Level 3 — Review of Supervisor’s Decision

Within ten business days of the date of the decision at Level 2, the community member may apply to the next level of supervision within the organization for a review of the decision with the understanding that further review will be conducted if:

   a written decision was not produced within the timeline, or

   there has been a violation of Board of Education policy, or

   the review process was not followed

The request for review shall be in writing, submitted to the appropriate person, and shall state the issues for review and the reasons why further review is needed. It shall be within the discretion of the person conducting the review to act on the request for review. If accepted, any such review shall be limited to the Level 2 decision, the written information compiled at Level 2, and the request for review. The Level 3 decision shall be in writing within 10 business days.


If the Level 3 decision is not satisfactory, the citizen may request to place an item on the agenda for either a public or executive session of the Board of Education by notifying the Superintendent in writing within ten business days of the Level 3 decision. The Superintendent will communicate with the Board of Education president, and the Board of Education will consider placing requests on a future Board of Education agenda.

The Board of Education has the discretion to decide if requests will be heard and whether an item will be discussed in public or executive session except as otherwise provided by law. Complaints about personnel, if considered, will be handled in executive session. Such decisions will be made and communicated in a timely fashion.

Decisions Involving Large Groups or Multiple Requests

When multiple requests or large groups are involved, they will be combined into a single proceeding where practical, and the same process shall be followed. At Levels 1 and/or 2, a large group meeting or forum may be held at the discretion of the staff member or supervisor who is conducting the review.

 

Examples of Levels of Review

     Example 1  —  Teacher Decision

       Level    1  —  teacher, parent, and/or student

       Level    2  —  assistant principal or principal

       Level    3  —  principal or appropriate supervisor

     Example 2  —  Principal Decision

       Level    1  —  principal and parent and/or student or others as appropriate

       Level    2  —  assistant superintendent

       Level    3  —  Superintendent

     Example 3  —  Assistant Superintendent Decision

       Level    1  —  assistant superintendent and parent and/or student or others as                                                            appropriate

       Level    2  —  Superintendent

       Level    3  —  Board of Education
